1. Acceptance of Terms

By accessing and using RealTalk ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use this service.

2. Description of Service

RealTalk is a community-driven real estate transparency platform that allows users to share information, observations, and opinions about property listings. The Platform enables users to post community notes about properties, flag potential issues, and share their experiences with real estate listings.

3. User-Generated Content

You understand and agree that:

  • You are solely responsible for the content you post on the Platform
  • You represent that your content reflects your genuine personal observations and experiences to the best of your knowledge
  • You have the right to share the information you post
  • Your content does not violate any applicable laws

4. Not Professional Advice

Nothing on RealTalk constitutes legal, financial, structural, or real estate advice. Community notes are personal observations only. Always conduct independent due diligence before making any real estate decision. RealTalk does not verify, endorse, or guarantee the accuracy of any community note, renovation estimate, flood risk opinion, or any other user-submitted content.

5. Section 230 Protection

Pursuant to Section 230 of the Communications Decency Act (47 U.S.C. § 230), RealTalk is an interactive computer service provider and is not liable for content posted by users. As stated in Section 230(c)(1):

"No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider."

This means that RealTalk is not responsible for user-generated content, and users retain full responsibility for their posts.

6. Community Guidelines

Users agree to:

  • Post observations to the best of their genuine personal knowledge and experience
  • Not harass, threaten, or intimidate other users
  • Not post hate speech or discriminatory content
  • Not share private or confidential information about individuals
  • Not use the Platform for commercial solicitation without authorization
  • Not attempt to manipulate ratings or reviews artificially

7. Content Removal

RealTalk reserves the right, but not the obligation, to remove content that violates these terms or community guidelines. To report content that you believe violates our policies, please contact us with:

  • The URL or description of the content
  • The specific violation you believe occurred
  • Your contact information

We will review all reports in accordance with applicable law, including the requirements of Section 230.

8. DMCA Compliance

RealTalk complies with the Digital Millennium Copyright Act (DMCA). If you believe that content on the Platform infringes your copyright, you may submit a takedown notice to us containing: (1) identification of the copyrighted work claimed to be infringed; (2) identification of the infringing material and its location on the Platform; (3) your contact information; (4) a statement of good faith belief that the use is not authorized by the copyright owner; and (5) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner. Upon receipt of a valid DMCA notice, we will remove the identified content promptly.

9. Disclaimers

The information on RealTalk is provided "as is" without any warranties, express or implied. RealTalk does not:

  • Guarantee the accuracy of user-generated content
  • Verify all claims made by users
  • Endorse any opinions expressed by users
  • Provide professional real estate, legal, or financial advice

10. Limitation of Liability

To the maximum extent permitted by law, RealTalk shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or reliance on user-generated content.

11. Indemnification

You agree to indemnify and hold harmless RealTalk, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform or content you post.

12. Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of the Platform shall be resolved through binding arbitration in the State of New Jersey, rather than through court litigation, except where prohibited by applicable law. You waive any right to a jury trial or to participate in a class action lawsuit with respect to any such dispute.

13. Modifications

RealTalk reserves the right to modify these terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified terms.

14. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions.
